ok, all buttons on the back are set to accept both.

yet every signle bit of software i have tried and use, simply wont allow anything but what it wants ie it will not let you select anything from 4:3 to 16:9.

all other options are fadded out and i have no idea how to sort this out as i have said all tabs are set to take 16:9 but it always captures at 4:3

How are the DIP switches on the bottom set? Are you aware that 16:9 and 4:3 both record at the same resolution (720x576 for PAL) but different pixel aspect ratios?

Yes, that is correct, the ADVC300 always sets the internal flag of the captured DV file to indicate it is 4:3. It does this because it can't tell whether the analog signal is 4:3 or 16:9. What you must do in your video editor is tell the editor that the captured DV file is really 16:9. The editor should allow you to do this.

Though I've never captured analog 16:9 material (it's all many years old and thus 4:3), I think the ADVC-300 can capture 16:9 by setting the DIP switches on the bottom accordingly. If you set switches 2.4 and 2.5 to the ON position, I would expect a 16:9 signal to record as 16:9:

Where "16:9" here means "anamorphic" - you tell your NLE to do the 16:9 flagging.

Sorry, but that aspect ratio selection is only for the external monitor (D1 output). It has no effect on what you capture.

            From the manual:

            No.4 Aspect Ratio Enable setting
Allows you to enable the aspect ratio setting (No.5 Aspect Ratio
Select). If set to [OFF: Disable], the aspect ratio of “4:3” is used for
            D1 output.
            OFF: Disable ON: Enable
            No.5 Aspect Ratio Select setting
Allows you to select the aspect ratio for D1 output.
            OFF: 4:3 LetterBox ON: 16:9

Ken is correct. That switch only affects the output.

so basically, the aspect ratio only applies to output vieiwing, so therfore i will always capture at 4:3

plus, why is it on every software ive used its never given me an option to what to encode with , what audio to use etc. it will show these options, but they will never be active

Correct, you're always capturing 4:3 DV.

Your software won't give you encoding options because it's not doing any encoding. The ADVC is encoding the video to a compressed DV format stream, and the capture software is simply copying that stream to the hard drive, just like copying a file from one place to another.
